 Also, Steve Pugh has introduced 2 bills for the legislative session which begins next Monday.  One that reflects
what Mr Layrisson is reporting and another for the entire judgment plus interest.

 NEWS UPDATE
 Re: 1983 Flood Judgment (Final 2006)

Given the many calls We have received lately from you, I want to give you a
brief update on the status of collection efforts on our judgment. We continue to Work
with the Commissioner of Administration of the State of Louisiana, as well as the
executive counsel to the Governor, to try and reach a long term payment agreement.
The Commissioner, I believe, is a good man that would like to see us get paid. We do not have a deal yet, but they have agreed to keep making annual payments (unconditional) until a long term deal can be reached.
We have made progress with obtaining recent appropriations and Working to get
them moved to an escrow account soon; we have set up in your benetit and which can
only ‘oe touched on court approval. We have obtained a commitment from the
Administration to get additional funding in this next legislative session. The upshot is
we hope to have somewhere near $10,000,000 inthe escrow account by the end of this
year’s session. A drop in the bucket perhaps, but at least it’s a step in the right
direction and it’s also being made without us giving up anything other than credit for
the payments against the judgment and nothing else.
We have been assured that if the State of Louisiana is successful in recovering
other monies from third parties that are in current litigation that the State will then be
open to working out a long term final deal to pay the judgment (so we are no longer
 year to year). These negotiations are being handled by our lobbyists, attorneys, and
 special counsel, Mr. Fayard, and are very sensitive. No deal will be approved without
 a chance for you all to be apprised of it and approved after a fairness
hearing held and noticed per the court.
We plan to give all of you a formal and full update after this legislative session.
As always, you are welcome to call me or my assistant, Ms. Nikki Toups, or any other
class counsel involved, namely Mr. Scott Love, Mr. Henry Terhoeve, Mr. Andrew
Edwards, and Mr. Fayard. I do not think they can tell you anything more than what I have here, but we are all open to your questions.

All of these people worked hard, for practically no pay but broke their backs for what they owned and lost: Alma Elouise Howes-Gay, Henry B. Gay, David C. Sibley, Lucille Sibley, Sam Joiner, Katie Matthews.

If the state of Louisiana cannot be held liable after this many years for the state construction and their workers of the I-12 interstate construction; then that is absolutely horrific. These were (past tense) cause they are all leaving one after the next.

Sometimes I think back to that morning - My awakening was to H.B. Gay (my paw-paw) with a small pair of rubber boots to get me out of my bed to step in water up past my ankles at that point. He scooped me up and there outside, Michael , Elvin, and David we're walking through the water waist to chest deep (guy's 6'1" and 5'11") that's not that small. The very first thing I saw was my little oven toy box with the few toys I had floating away to the creek that laid the property line between us and the Hannah's. I was chunked into a boat watching boat's coming up and all around. They got us to the top of North Thibodeaux Rd by the Robertson's and Sheridan's and we were able to get in a vehicle and make it to my pawpaw Don's in Hammond.

Still this very day; I can close my eyes,and see, Jerry Ishes store submerged to the sign,completely under water. All of the cows, horses, dogs, nutria rats, cats, chickens and all animals dead floating or trying to stay on the top of a roof or in trees.

I hope for those who suffered and lost; and have lost those as I have that one day this will come to an end before no-one that was there, or that will remember that day will still be around.

For those passed; the respect they deserve for the hard work they did to earn what they had; that their children have now, and they to can still close their eyes and see what happened that day.

To this day; I have been asked on several cruises and somehow as bad as I would love to visit the islands by cruise ship. Something in me will not allow it. I have always thought about that day, and how hard and long it was to rebuild and all the heartache it brought to so many. To all survivors and those laid to rest; I hope this can finally come to an end.

Happy Independence Day all. For many who are still trying to throw King George's tea into the bay in an attempt to effect some justice, it may seem appropriate that today there finally is some good news. If you haven't seen the Ponchatoula Times from Wednesday last, an interview with Mr Jean-Paul Layrisson has yielded new information. The fact that the State of Louisiana has appropriated $6 million to be placed in some sort of escrow account for the benefit of the plaintiff's is good news but for the 1st time the concept of "NO STRINGS ATTACHED" is included, and to this layman anyway; that sounds like REALLY good news. The Court will decide when it's appropriate to begin awarding class members their due.


Your Honor, we plea; please start with the folks who quite literally almost drowned and/or those who are in their 70's & 80's (excluding my Mother, she's going to be fine). There are folks who are really in need of some relief. We pray that NOT ONE more of them passes, before seeing "some" recompense for their sacrifices. I'm thinking a formula that is a function of proximity to the flood, economic status and age. But I'm sure y'all are way ahead of me there.

To our Counsel et al, nicely done Gentleman. If, in an economy like this, some of this money actually makes it into the hands of the folks who need it the most, then it is actually a job very well done and many of us are very appreciative. You will have done something that no one else has, in lo these many years, and I for one; am glad I don't have to dress up as an Indian or go to Boston, for another year. Again, thank you.

They have added mr. Calvin Fayard to the team as a special council member, to assist with collection. He has good standing with many people in our government. His hiring will come with no extra pay but will come out of the over all attorneys fees. They have submitted a formal proposal of judgement which has been hand delivered to the governors council.
They have been able to make a good relationship with Mr. Paul Rainwater the commissioner of administration for the state. The payments and total payment amounts have been left blank until the states budget criteria has is more definitive. Our hope is that if and when the state has identified the funds wether it be from B.P. money grants or any other source they or we help them find the settlement will be done quickly since the the agreement is already in place.

As for the $2,000,000 in godd faith funds they recieved last year. Was given for payment for us to encourage the governor office to engage in settlement negotiations. Mr. Rainwater has ensured that those funds are still there and will be delivered at the appropriate times.

They also have a number of Washington lobbyist, local lobbyist and p.r. Experts. The entire local legislature delegation was very helpful in getting the appropriation led by sen. Julie Quinn. They have for the first time a friendly and open relationship with the governor and his top. The only problem is that the state is having financial difficulties.

They want everyone to wright there ligislators and senators and go errors to let them know how important this issue is to you and your families. Do not hesitate to call layrisson, Edwards, Love, or Terhoeve

I have backed off publishing updates for a couple of reasons.  1) NO INFORMATION is forth coming from ANYONE, & 2) I have been singled out as the victim in this grassroots effort to do what NO ONE has been able to do in 28 years.  Very important people in this Parish are willing to attack me ad-hominem.  Why kill the messenger because you don't like the message?  Why are very important people in this Parish apparently apposed to any effort to effect justice?  I'm not buying any more yard signs or calling off the phone bank list.  Am I expected to take back the website I donated?

With all the distractions not with standing, this is not about me.  This is about justice for oppressed tax paying citizens still living with buckled floors because of the State's negligence... Attempts to make this about me are seemingly "red herring" in nature... And $5 will get you $8 that if my uncle were still alive and taking care of family business, you wouldn't be vilifying him.

Unfortunately the 4th edition signs won't be ready until Monday afternoon. I have a few of the the 3rd edition signs left and am planning on putting them around the capital. If anyone else who has signs now and wants to lend them to the effort, please let me know and we'll replace them Monday.

It is with some sadness that I bring y'all, my fellow class members, this latest of news.  13 months ago my Brothers and I decided this was a worthwhile, legitimate & honorable endeavor.  We didn't anticipate this type of political animosity and "dirty pool" so often associated with political campaigns, but alas; that's where we are.  Apparently no one possesses the fortitude to tell us why what we are doing is wrong.  Why we don't all have the same objective?  When such an obvious question seems unanswerable, my Brother says, "follow the money."  He's real smart.  Obviously someone has something to gain.  Enough so that they're willing to go to great lengths to silence the unification of our voices.  I have survived a plot to get me busted in a stolen vehicle, an assault by a degenerate, an extortion attempt, the theft of my eyeglasses, the theft of countless yard signs, called a homosexual by a Deputy Sheriff & I quite possibly set a record, as being the subject for the most background checks performed in a 2 day period. 

Also, I have contributed over $1000 of my family's money and contributed 100s of hours creating and maintaining i12exit47.com.  (BTW... If anyone is interested in taking over that duty, please feel free to let me know, it's YOURS.) 

The years legislative session has begun.  To my knowledge, there are no signs remaining around the capital.  I know of no state legislator who was asked permission for a sign in his/her yard.  Even though the only identifiable voice for the opposition claims to not be the opposition, the truth is; our united voice has been squelched.

You see fellow class members, my Mother paid a dear price for the State's negligence, and that's sad, but she is going to be "alright."  What makes me more sad though, is the 100s of folks I've met and heard about that were/are NOT "alright"... then, now or at the time of their PASSING.  To leave these victims forgotten and oppressed is a crime.  The Courts have ruled as such.  But up until recently the State sponsored oppression appeared to be passive and based mostly in negligence.  However, last night that all changed.  It was an official looking unmarked crusier, white 4 door Ford or Chevy sedan, with the spotlight on the drivers door, which stopped, and under the cover of darkness, trespassed onto my family's private property and stole i12exit47.com signs.  Apparently, it is the State, to some degree or another, that has a stake in silencing me and keeping the rest of the class divided and conquered.  Had I known this from the beginning, I'd of told my Brothers where to stick this assignment.  The State will take the "high ground" tomorrow in criminal courts across the land proclaiming things like "peace" and "dignity" while ignoring their moral, if not solemn, obligation.  Somehow I think the Founding Fathers of this Country envisioned something different. 

I can envision few "just causes" more deserving than the plight of these flood victims, it's just not worth my life.

To whom it may concern:  I quit.  I am not a political person and I apologize for stepping on your toes.  Apparently I do not have the stout heart and the true soul necessary to carry me further.  There are things in my past I'm not completely proud of but there is nothing I am too embarrassed or afraid to address.

To Jean Paul Laryisson & my Cousin Andrew Edwards:  I'm sorry for any negative implications or untruths published.  They sincerely were never meant personally or maliciously.  I always have and continue to hold out great hope that we are actually all on the same side and some finality and closure is really just around the corner.    I just wish y'all had contacted me, or better yet; Joe Perrin and explained the fallacy in our logic.To our fellow class members, if you can remain organized and focused, my family pledges as much in resources as we can muster, to effect justice.  God's Speed to us all.  2:09 PM 3/11/2011 by Bobby Lee
As many of you are aware the topix.com forum has been the venue for an ongoing dialogue with "Jessie" who seems to represent lead counsel.  I posted the following earlier today in response to his correcting some inacurrate information I had posted.

"Mr Jessie Sir, I apologize for the inaccurate information posted. I'm thinking that if you could find half the class members not 10% could tell you who lead counsel is. This seems to underscore the frustration many of us, as class members, feel and frankly; is the reason i12exit47.com exist. I have had contact with over 300 class members and only 3 have indicated that they've been kept abreast of developments or are adequately represented. As you've stated, it's important that we present a unified voice and we are willing and anxious to aid the cause. BTW... the yard signs work. If you were willing to buy half of what you offered in a previous post, it'd be a God send. My exact cost is $4.52 each. If you bought 50, I'd donate the 52 cents and only charge you $4 a piece."

Everyone, call your legislators or better yet... buy a sign and put it in his/her yard.  And this is not just Bobby Lee asking.  To quote Jessie, "They want everyone to wright their legislators and senators and go errors to let them know how important this issue is to you and your families."
Let's not let him down.

Very good job with the yard signs folks as they're attracting attention.  However, we're making someone uncomfortable as they're going on to private property to steal the signs.  I have purchased two deer cameras.  If anyone else has deer cameras they'd like to donate for a few months, please let us know.  The 3rd edition signs are available for only $5 each and can be picked up in Robert at Cheryl Bardwell's residence.  Please give her a call.

First, and foremost, I want to thank those of you responsible for this informative
website.  Only today have I become aware of this website—basically as a
result of a poster on Hwy. 190.
Never before since the flood have I been provided as much insight into the matter. Insight which is of concern to each of us as flood victims.

 

 Insight also into the number of good people who, unbeknownst to me, have picked up the banner.  I know none of the individuals personally but certainly now give ‘thanks’ for their stepping up to the plate.

Though a lot of the comments, I have read during the past two hours, have been negative to certain individuals I prefer to stand alongside those who are more interested in putting their energies to constructive use rather than blasphemy.

Therefore, if I am able to be of service in this just cause I offer myself.

We had a tremendous meeting Saturday January 8th.  Too bad the Saints can't say the same thing.  But since they're millionaires, and I'm not, I ain't gonna cry too hard or too long.  Tackling runners and covering receivers is a fairly important part of football, you would think.

At the meeting, however; we had a much bigger turnout than any of us could have imagined.  Our "grass-roots" effort has not just "seeded" but DECIDEDLY begun to grow.   

The heartfelt frustration experienced by so many was evident as folks have strong feelings and a right to "vent" against State oppression.  But "venting" amongst ourselves is not productive.  What our class needs is to unify in voice and action.  To that end, I propose we continue to organize with the following objectives.

First and most important, reach our goal of class member registration.  Please call someone and help them register ati12exit47.com 

2) Form a Committee to organize and then "pull off" a general class member meeting in 6 to 8 weeks.

3)  Establish Joe Perrin's staff & Class Officers.  Such as...

-Secretary of Protocol by Robert's Rules.
Prepare meeting Agendas & officiate meetings.

-Secretary of Action
Spokesman and Coordinator of the manifestation of our United Quest.

-Secretary of Finance

-Secretary of Media Relations.

All ideas welcome.  Class participation urgently encouraged.  If you can work on the phone, let one of us know and we'll get you a list.  We will be forming action committees so please stay tuned to i12exit47.com and lend a hand where possible.

Help us help you... Working together we will find closure.

Thanks to all who have registered, 
And thank you (ALL so much for responding to our call for class unification.)  We have worked very hard to make sure that the class does not crumble out of frustration due to stagnation.   I was 17 at the time of the flood and helped both my family and neighbors to safety.  My mother was following things closely for years, but like many older generation class members, she has fallen ill and asked me to continue the pursuit for resolution on my family's behalf.  It's been a very eye-opening experience on many levels.  The attorneys truly don't know what else to do...claiming that the state is broke.  Even so, our class is not content with taking this as the final chapter.  For too long the attorneys and class members have taken their eye off of the ball.  We have been pointing fault at attorneys, taking sides with attorneys, when that's really not benefiting anyone.  We are to the point where we all need each other,  and now we all truly see that everyone wants this to come to some sort of resolution.  So, we want to send a strong message to our counsel and class members that our newly reformed Class Action Team will work openly and cohesively to gain the administration's attention.  We want the class members to have a venue to voice opinion, lend support, and receive accurate status updates.  We will be reviewing and implementing action steps that bring continued focus back to this judgment.  We value input such as yours and would be appreciative any insight or strategic ideas any of you may have.... Regarding (the) question about the state carrying liability insurance, good question and one I had not considered.  I would like to think that if this were the case, our attorneys would have already pursued this avenue...but I do not know.  We need to research this and have dialogue with our counsel regarding the viability of pursuing.  Please feel free to call me should you want to speak more and I truly appreciate your willingness to share your insight and ideas.

I am the next of kin for my father, Lester E. Hoover who was a flood survivor.  He passed away on 9/2/2009.  In several of our conversations he mentioned he would never see this case settled, that has proven true.
Please add his name to the list of those who have passed.

Now that someone is trying to gain information for all of us with questions and keep us informed, that is a bad thing?

We've come to the end of another year.  A year that was happy at times, but also; had some sadness.  There were losses to be sure, but also; there were gains.  In this last year a group of the Flood of 1983 survivors organized and decided to seek the truth and determine if the State of Louisiana had a moral "leg to stand on" in denying its culpability and RESPONSIBILITY in this preventable tragedy.  To my knowledge, no one has even tried to argue that we are not completely and morally justified in seeking redress.  From a handful last summer to now more than 150 members strong we have taken a very big step towards unifying our voices and demanding justice.
 
Now we need to unify our efforts as well.  All of you know someone who is a flood class-action law suit member.  Pick up the phone and call them please.  Direct them to i12exit47.com.  If they are without internet access, register for them or have them call one of the existing or proposed class representatives (phone numbers are on the website).  If they've already registered, urge them to call someone they know.  If you're part of family with many members (see Bennett's, McBrides, Mathews...) become the family team captain and get everyone registered. 
 
If you needs names and phone numbers, please feel free to email me mayor@i12exit47.com and I'll provide a script and a list.  I've made a couple hundred phone calls but that's hardly a dent in a class this size.  Time is of the essence.  Rarely in life are we given the opportunity to effect justice with nothing but our raw human endeavor.  This is our chance.  Not so lucky are those who suffered but are not here to experience the closure they so richly deserved.
 
Yes it is the end of a year... But with God's will and our undeterred effort, let it also be the start of the last year that we are so contemptuously rebuffed.
 
May the New Year, for all of us, be NOT just happy; but also filled with long awaited justice.

I'm going to be distracted from our solemn quest tending to some family health issues.  Please be patient.  I'll find time to keep the site updated and I hope to be back full-bore soonest.  While I'm away NOT making phone calls we need y'all to step up and make them too.  Please, fill up that ballot/registration box... and may all of us have not JUST a Happy New Year... but a Happy AND "JUST" New Year!  May the Lord keep us all with us, until then.

Your proposed class representative team wishes everyone a magical holiday season. May this be our last Christmas without some sort of closure to this interminable saga.

Mr Jean-Paul Layrisson, we take you at your word that there is no nefarious agenda to oppress the victims of the State's negligence, however; as I've talked to well over a hundred class members, either in person or by phone, there is almost always two common themes. One, the State is in contempt of its own tax paying citizens and... Two, there has been NO communication of any kind from class leadership regarding OUR law suit, in YEARS.

Then we come to find out that several of the current class representatives haven't been contacted in YEARS. Mr Layrisson, what part of this do you believe is fair or even reasonable, please Sir? Just how patient do you expect an 85 year old victim to be?

The State needed to build a bridge. Instead, they saved a lot of money and built a dam and handed us the bill for their savings. Is this an inaccurate assessment?

You see Mr Layrisson, we have lots of questions but the most frustrating thing is, we feel like we've been oppressed and forgotten.

One last question please Mr Layrisson, if the tables were turned, just how patient would the State be with us?

Despite our differences, I know that my whole family joins me in wishing you and all the Layrissons a very Merry Christmas. After all, we've been neighbors for the better part of 90 years.

Season's Greetings and may the spirit of this wonderful holiday bring peace and joy to you all.
 
It's impressive indeed that a little more than a couple of weeks into this endeavor, we have 102 Flood Class Members registered.  That's roughly 15% of what's required to reform our class, increase accountability, improve information availability and otherwise combine our suffering, rights and surviving determination into ONE UNIFIED VOICE.
 
But we're far from the finish line and now is not the time to relax.  During this holiday season many of us will be spending time with family and friends, giving us a golden opportunity to make sure everyone -who needs to know, what's going on with our flood case - knows how to find  i12exit47.com, register and lend a hand.

"I was directed to (the topix) website to see what was going on about OUR web site (i12exit47.com).  I have been a class representative since day one. All we are trying to do is add some more class representatives to get information out faster to keep everyone informed in a timely manner. It does not matter what or who you believe. what matters is whether you want to be kept informed and this is what this site is for.I am a class representative and I have not been kept informed for 2 years now. This site is legal and all attorneys should be glade that we are doing this (Most Are). Great job and Thanks Bobby Lee for your hard work on this site.I also dido your comments.We must continue to work hard at this so maybe we will get paid before we all die."

I have been advised, via the topix website, that i12exit47.com is under investigation.

Under investigation for what? Obtaining and disseminating current and accurate information? We've been told for years that we're being adequately represented. If you are a class member and you feel adequately represented, then please don't vote. The rest of you may want to help us unite this class. I've asked from the beginning, why would anyone oppose our efforts to find closure?

We don't feel like that question's ever been answered. Convince the group of us, who are coordinating this effort, that we don't have that right please. Convince us that we're adequately represented please... Then we'll quit and I'll move on to zoning or something else.

On August 23rd Mr Jean-Paul Layrisson told a group of flood survivors that in "a couple of weeks" he would have news of a resolution. Later in that same meeting he amended his statement to "a couple of months, at the outside."

We've heard ALL this before. We are simply organizing in an effort to do what NO ONE has been able to do. Why would anyone oppose that? My Mother is 83 years old, how long do you propose she wait?

Dear Fellow Flood Class Member,
I contact you in a matter of utmost importance as too many years have passed without accountability.  If you or I were to build a dam which floods our neighbor's home and property, not to mention; psychological health, the Great State of Louisiana would hold us accountable (even if we did not know or we could not have foreseen the unintended consequences of our action.)
 
Therefore, in an attempt to (at the very least) be kept abreast of the newly rejoined negotiations and then disseminate quickly, effectively and accurately, the resulting progress, we ask for your help.
 
First, please visit our newly created website i12exit47.com and complete the registration process, which declares your intent to add new class representatives and to elect me as your reformed class president.
 
*  Much of the Parish is still without internet service.  If you are unable to visit the website (or print the registration form) please call one of the numbers below.  By hook or by crook, we will get you registered.

To all Fellow Class Members:
Much work has been done, in the recent weeks, to devise a method, to which, class members can vote and it now be valid.   We did have to make some changes...so if you voted, please go back to the site and follow the instructions completely as we need a signature with the member registration # for the vote to count.   I would like to compliment Bobby Lee on his persistent efforts in constructing such a website and his diligence in helping us maintain focus.  To reiterate, our goal is not yet accomplished.  The time is soon coming where we will be presented an offer.  My concern, is that such an offer will be one that falls well short of our rightful judgment.  To this end, it is of vital importance that each of you be proactive in getting people to our site for voting purposes.  I have been made aware that all counsel now know of what we are attempting to do.  They are already reaching out to many trying to convince them not to vote.  My question...and the question you should present to anyone you speak with...is why would counsel have a problem with us structuring a more sound and unified class?  We are moving the effort forward to guarantee a fair settlement and form a more structured team of individuals better suited to communicate efficiently with the class.  No counsel, with their priorities lying with the class, should object.
